General & Conditions for Accommodation Contract

Article1.【Scope of application】

The accommodation Contract entered with our Guesthouse and its related contracts shall be based on this Contract,and any matter not stipulated in this Contract shall be governed by ordinance and generally established practice.

Notwithstanding the preceding clause,Our Guesthouse can include extra contract so long as it does not conflict with the intent of this Contract.ordinance and generally established practice.

Article2.【Applying for Accommodation Contract】

The Guest is required to present the following information before applying for the Accommodation Contract:

⑴Name,address,age,phone number,gender,occupation and length of stay.

⑵Nationality,passport,number,previous place of stay and the next place of stay in case of a foreign guest.

⑶Date of departure,number of guests,time of departure,and age classification of guests sharing a room(Adult•Child)

⑷Other information deemed necessary by our Guesthouse.

In case the Guest has decided to extend the length of stay,period of contract binding shall be extended as well.

Our Guesthouse refuses accommodation of any person under 16years old of age,including all high school student,who haven't their family or guardian over 20 years olf of age go with.

Our Guesthouse refuses accommodation of any child under 5years old of age,including who have their family or guardian over 20 years old of age go with.

Article3.【Conclusion of Accommodation Contracts,etc.】

A Contract for Accommodation shall be deemed to have been concluded when the Guesthouse has duly accepted the application as stipulated in the preceding Article.However ,the same shall not apply where it has been proved that the Guesthouse has not accepted the application.

When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding paragraph,the Guest is requested to pay an accommodation deposit set by the Guesthouse within the limits of Basic Accommodation Charges covering the Guest's entire period of stay by the date specified by the Guesthouse.

The deposit shall be first used for the Total Accommodation Charge to be paid by the Guest,secondly for cancellation charges under Article 6 and thirdly for reparations under Article 18 as applicable.The remainder,if any,shall be refunded at the time of payment for accommodation as stated in Article 12.

If the Guest fails to pay the deposit by the date as stipulated in Paragraph 2,the Guesthouse shall treat the Accommodation Contractas invalid.However,the same shall apply only in the case where the Guest is thus informed by the Guesthouse when the period of Payment of the deposit is specified.

Article4.【Special Contracts Requiring No Accommodation Deposit】

Notwithstanding the provisions of Paragraph 2 of the preceding Article,the Guesthouse may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.

In the case when the Guesthouse has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of payment of the deposit at the time the application for an Accommodation Contract has been accepted,it shall be treated as though the Guesthosue has accepted a special contract prescribed in the preceding Paragraph.

Article5.【Refusal of Accommodation Contracts】

The Guesthouse may not accept the conclusion of an Accommodation Contract under any of the following circumstances:

⑴When the application for accommodation does not conform with the provisions of these Terms and Conditions;

⑵When the Guesthouse is fully booked and there is no vacancy;

⑶When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation;

⑷When the Guest seeking accommodation can be clearly identified ad carrying an infectious disease;

⑸When the Guesthouse and/or Guesthouse staff are violently threatened or unreasonably burdened by the Guest;

⑹When the Guesthouse is unable to provide accommodation due to natural calamities,malfunction of facilities and/or other unavoidable causes;

⑺When the person requesting Guesthouse accommodation is obviously intoxicated and could cause annoyance to other guests or when the person is behaving in such a manner as to be an annoyance to other quests;

⑻When the person requesting GUesthouse accommodation is a member of an organized crime group,under Article 2-6 of Law on Preventing Unreasonable Conduct by Organized Crime Groups(Code77issued in 1991),or a related party,under Article 2-2 of said law;

Article6.【Cancellation of Reservation】

When an applicant who sought to make reservation for accommodation cancels in whole or in part their accommodation reservation,our Guesthouse may ask for compensation in ways listed below.

⑴In the case that a reservation is canceled 5 days prior to the first day of stay.there shall be a penalty of 20% of the accommodation charge.

⑵In the case that a reservation is canceled 4 days prior to the first day of stay.there shall be a penalty of 30% of the accommodation charge.

⑶In the case that a reservation is canceled 3 days prior to the first day of stay.there shall be a penalty of 40% of the accommodation charge.

⑷In the case that a reservation is canceled 2 days prior to the first day of stay.there shall be a penalty of 50% of the accommodation charge.

⑸In the case that a reservation is canceled on the day before the first day of stay,there shall be a penalty of 80% of the accommodation charge.

⑹In the case that a reservation is canceled on the day of stay and the guest does not make contact and does not arrive,there shall be a penalty of 100% of the accommodation charge.

if the guest does not arrive by 11pm on the first day of occupancy,or 2hours after expected check-in time in case it has been specified in advance,our Guesthouse may deem that reservation have been canceled and handle it accordingly.In the case that areservation is deemed canceled but the reason for the guest not making contact or arriving at the Guesthouse is proven to have been caused by public transport such as train,plane or other causes beyond the control of the Guest,the penalty mentioned in Article6 will not apply

Article7.【Right to cancel Accommodation Contract by the Guesthouse】

⑴When the Guest is deemed liable for conduct and/or has conducted himself/herself in a manner that will violate laws or act against the public order and good morals in regard to his/her accommodation;

⑵When the Guest can be clearly identified as carrying an infectious disease;

⑶When the Guesthouse and/or Guesthosue staff suffers from violent threat or unreasonable burden from the Guest.Or,when it is acknowledged that similar activity has occured in the past;

⑷When the Guesthouse is unable to provide accommodation due to natural calamities and/or other causes of force majjeure;

⑸When the person requesting Guesthouse accommodation is obviously intoxicated and could cause annoyance to other guests or when a person is behaving in such a manner as to be an annoyance to other guests;

⑹When the person requesting Guesthouse accommodation is a member of an organized crime group,under Article 2-6 of Law on Preventing Unreasonable Conduct by Organized Crime groups(Code77issued in 1991),or a related party,under Article 2-2 of said law;

⑺When the Guest does not observe prohibited actions such as smoking inside the building,tampers with fire-fighting facilities and otherwise breaches Guesthouse Regulations stipulated by the Guesthouse(restricted to particulars deemed necessary in order to avoid causing fires);

If the Guesthouse has canceled the Accommodation Contract in accordance with the preceding Paragraoh,the Guesthouse shall not charge the Guest for any of the services during the contractual period he/she has not received.

Article8.【Accommodation Registration】

The Guest is required to present the following information before registering for the accommodation services:

⑴Name,address,age,phone number,gender,occupation and length of stay;

⑵Nationality,passport number,previous place or stay and the next place of stay in case of a foreign guest;

⑶Date of departure,number of guests,time of departure,and age classification of guests sharing a room(Adult•Child)

⑷Other information deemed necessary by our Guesthouse;

All Guests of foreign nationality who do not reside within japan will be asked to leave a photocopy of their passport with the Front Desk.

Article9.【Occupancy Hours of Guest Rooms】

The time allowed for the Guest to use guest room at our Guesthouse shall be from 4pm of check-in day to 11am of the following morning.If the Guest stays more than 1day in succession,the Guest may use the guest room all day except for the day of arrival and the day of departure.

The Guesthouse may,notwithstanding the provisions prescribed in the preceding paragraph,permit the Guest to occupy the guest room beyond the time prescribed in the same Paragraph,In this case,extra charges shall apply as follows:

⑴Up to 1 hours: % of the room charge.

⑵Up to 2 hours: % of the room charge.

Article10.【Observance of Guesthouse Regulations】

The Guest shall observe the Hotel Regulations established by the Guesthouse.

Guesthouse Regulations are posted within the premises of the Guesthouse.

Article11.【Business Hours】

The business hours of the Guesthouse

Reception 7:00am-11:00am 5:00pm-11:00pm

The business hours are subject to temporary changes due to unavoidable circumstances of the Guesthouse.

In such cases,the Guest shall be informed by appropriate means.

Article12.【Payment of Accommodation Charge】

Accomodation charges shall be paid even if the Guest voluntarily does not utilize the accommodation facilities provided for him/her by the Guesthouse.

Article13.【Liabilities of the Guesthouse】

The Guesthouse shall compensate the Guest for damage if the Guesthouse has caused such damage to the Guest in the fulfillment or the nonfulfillment of the Accommodation Contract and/or related agreements.However,the same shall not apply in cases where such damage ha been caused due to reasons for which the Guesthouse is not liable.

Article14.【Handling when Unable to Provide Contracted Rooms】

The Guesthouse shall,when unable to provide contracted rooms,arrange accommodation of the same standard elsewhere for the guest insofar as practicable with the consent of the Guest.

Article15.【Handling of Deposited Articles】

In case of lost or damage of any belonging while deposited at our reception area,our Guesthouse will take full responsibility and pa suitable amount of compensation to the owner.

We do not take any responsibility for lost or damage that is caused by the following;

⑴Any kind of item that is not allowed to be deposited,including but not limited to items in Article 14 Paragraph3.

⑵When the lost or damage is caused by the unavoidable,such as natural disasters and other reasons which are outside our control.

⑶When the object is required by judicialauthority,government,public offices,or officer of law,to be confiscated as evidence.

⑷When the damage is caused by illegal acts of third party.

⑸Any other circumstances where responsibility for the damage ultimately does not belong to our Guesthouse or personnel.

We do not allow deposition of the following articles:

⑴Valuables such as pocket money,wallet,important documents,passport,blueprint and those deemed invaluable to the Guest.

⑵Dead body.

⑶Animal.

⑷Volatile chemical,explosives,other dangerous substances

⑸Gun,sharp object,weapon,and any other object that deemed dangerous or can be used to commit any kind of criminal assault.

⑹Any substances and objects that give off a foul odor,or likely to decompose and spoil.

⑺Anything deemed to be dirty or damaging to the Guesthouse or other deposited baggage.

⑻Anything defined by law to be illegal to have in possession.

⑼Anything deemed unacceptable for deposition.

Article16.【Custody of Baggage and/or Belonging of Guest】

When the baggage of the Guest is brought into the Guesthouse before his/her arrival,the Guesthouse shall be liable to store it only in the case shen such a request has been accepted from the Guesthouse.The baggage shall be handed over to the Guest at the Front Desk at the time of his/her check-in.

When the baggage or belongings of the Guest are found after check-out and ownnership of the article is confirmed,the Guesthouse shall inform the owner of the article left and ask for further instructions. When no such instructions are given to the Guesthouse by the owner or when ownership is not confirmed ,the Guesthouse shall haandle it according to the Lost Goods Act.

Article17.【Liability in Regard to parking】

Our Guesthouse does not have a parking area.Please arrive by public transport.

Article18.【Liability of the Guest】

The Guest shall compensate the Guesthouse for damage caused through intent or negligence on part of the Guest.

Article19.【Using of Computer and Digital Communication】

Any compromises caused to user,including but not limited to damaging of user data,leaked personal information,damage from virus and spyware,and unpleasant online expeience,are responsibility of the Guest alone.Our Guesthouse does not take any responsibility for any damage caused by Guest's usage of computer or digital communication in our Guesthouse.

Article20.【Governing Language】

These terms are provided in both Japanese and English.in case of a discrepancy between the Japanese and the English,the Japanese version will take precedence.

Article21.【Jurisdiction and Applicable Laws】

Litigation arising from the terms &Conditions for Accommodation Contract will be resolved in the courts in the jurisdiction of the Guesthouse and in accordance with Japanese law.
